- Prior to the merger, eligible participants could contribute through salary reductions up to 70% of eligible pre-tax annual compensation, as defined, limited to the maximum amount allowable under the provisions of the Internal Revenue Code (IRC).
- The Plan allowed for catch-up contributions for participants who had attained age fifty by the end of the plan year.
- The Plan allowed for participants to make after-tax (Roth) contributions.
- Prior to the merger, the Company, at its election, could make a discretionary matching contribution.
- Participants were immediately vested in their voluntary contributions and actual earnings thereon.
- Vesting in discretionary employer contributions and any earnings thereon was based on years of service.
- A participant would be 100% vested, based on a cliff vesting schedule, after two years of credited service, as defined in the plan document.
- In the event of death, disability, or attainment of the age 62, participants’ accounts became fully vested.
